4.2 Allergen and Dietary Responsibility
It is your sole responsibility to review all menu descriptions, ingredient lists, and allergen information before placing an order. If you have severe food allergies or dietary restrictions, we strongly encourage you to contact us directly before placing an order.
5. Ordering, Payment, and Refund Terms
5.1 Order Placement
All orders placed through our website are subject to our acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion. In the event that an item you have ordered is unavailable, we will contact you to offer a suitable alternative or issue a refund for that item.
Once an order is placed and confirmed, it may not be possible to modify or cancel the order, as food preparation often begins shortly after confirmation. If you need to cancel or modify an order, please contact us immediately at [email protected] or by phone, and we will make reasonable efforts to accommodate your request.
5.2 Pricing and Payment
All prices displayed on our website are in United States Dollars (USD) and are inclusive or exclusive of applicable taxes as indicated on the checkout page. Prices are subject to change without prior notice. The price you are charged will be the price displayed at the time you complete your order.

Delivery services may be subject to a delivery fee and minimum order requirements, which will be clearly disclosed at checkout. Delivery fees are non-refundable unless we fail to deliver your order or deliver an incorrect order through our fault.
5.4 Refunds and Cancellations
If you are dissatisfied with your order due to an error on our part, such as incorrect items, missing items, or significantly substandard food quality, please contact us within a reasonable time of receiving your order. We will review your complaint and, at our sole discretion, may offer a replacement, store credit, or refund. Refunds, if approved, will be processed within seven (7) to ten (10) business days to the original payment method.

These Terms do not grant you any right, title, or interest in the website or its content beyond a limited, non-exclusive, non-transferable, revocable license to access and use our Services solely for your personal, non-commercial use in accordance with these Terms.
You may not:
- Reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as incidentally occurring in normal web browsing;

7. Third-Party Links and Services
Our website may contain links to third-party websites, services, or resources that are not owned or controlled by Pizzana. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party websites or services. We do not endorse or make any representations about any third-party websites or resources.
We strongly advise you to read the terms and conditions and privacy policy of every third-party website you visit. Your use of any third-party website or service is at your own risk and subject to that party's terms and conditions.
8. Disclaimers and "As-Is" Basis
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZANA PROVIDES ITS SERVICES ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PIZZANA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH OUR SERVICES;
- WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED;
- WARRANTIES THAT OUR SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
Pizzana does not warrant that food ordered through our Services will meet any specific dietary requirements, be free from allergens, or be suitable for individuals with specific medical conditions, beyond what is explicitly stated in our menu descriptions.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, such warranties are limited to the minimum extent permitted by applicable law.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL PIZZANA, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS;
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES;
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
- DAMAGES RESULTING FROM CONDUCT OF ANY THIRD PARTY ON OUR PLATFORM;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF PIZZANA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PIZZANA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PIZZANA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).
Some states do not allow the limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in its entirety. In such cases, liability will be limited to the fullest extent permitted by applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pizzana and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use or misuse of our Services;
- Your violation of any applicable federal, state, or local law or regulation;
- Your infringement of any intellectual property or other rights of any third party;
- Any content you submit, post, or transmit through our Services;
- Your negligence or willful misconduct;
- Any false or misleading information you provide to us;
- Any dispute between you and any third party arising from your use of our Services.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
11. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Pizzana's principal place of business is located, without giving effect to any choice or conflict of law provision or rule.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts of competent jurisdiction located in the United States, and you hereby irrevocably consent to the personal jurisdiction and venue therein. You waive any objection to the laying of venue of any such proceedings and waive any objection that such courts are an inconvenient forum.
These Terms are subject to and shall comply with all applicable federal laws, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 45) governing unfair or deceptive trade practices, the Electronic Communications Privacy Act, and other applicable federal consumer protection statutes.
12. Dispute Resolution
12.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our Services by contacting us in writing at [email protected] and providing a detailed description of the dispute, your desired resolution, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If the dispute is not resolved within that period, either party may proceed with formal dispute resolution as described below.
12.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THIS AGREEMENT TO ARBITRATE, SHALL BE DETERMINED BY BINDING ARBITRATION.
Arbitration shall be conducted by a recognized arbitration organization under its then-current rules and procedures. The arbitration shall take place in the United States. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND PIZZANA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Pizzana agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
12.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for disputes or claims within the scope of that court's jurisdiction, provided that the matter remains in such court and is not removed or appealed to a court of general jurisdiction.
13. Term and Termination
These Terms shall remain in full force and effect while you use our Services. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to all or any part of our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms;
- Remove or disable access to any content or information that we determine, in our sole discretion, violates these Terms or applicable law;
- Discontinue any or all aspects of our Services at any time, with or without notice.
Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may contact us at [email protected] requesting account deletion.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
14. Changes to Terms
Pizzana reserves the right to modify, update, or replace these Terms of Service at any time in our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. In some cases, we may provide additional notice of material changes, such as by posting a notice on our website or by sending you an email notification.
It is your responsibility to review these Terms periodically for changes. Your continued use of our Services following the posting of any changes constitutes your acceptance of and agreement to be bound by the revised Terms. If you do not agree to the modified Terms, you must immediately cease using our Services and, if applicable, close your account.
Any changes to these Terms will not apply retroactively to disputes or events that occurred prior to the effective date of such changes, unless otherwise required by applicable law.
15. Privacy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, describes how we collect, use, store, and share information about you when you use our Services. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
To the extent applicable, our data practices are subject to applicable federal privacy laws and the laws of the state in which you reside, which may include the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) for California residents. Please review our Privacy Policy for more detailed information.
16. Force Majeure
Pizzana shall not be held liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, strikes or other labor disturbances, shortage of transportation facilities, fuel, energy, labor, or materials, government actions or regulations, power outages, internet service disruptions, or any other event beyond our reasonable control.
17. Severability
If any provision of these Terms of Service is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, void, or unenforceable for any reason, that provision shall be deemed severed from these Terms, and the invalidity, illegality, or unenforceability of such provision shall not affect the remaining provisions of these Terms, which shall continue in full force and effect to the maximum extent permitted by law.
The parties agree that the court or arbitrator shall modify any invalid or unenforceable provision to the minimum extent necessary to make it valid and enforceable, consistent with the original intent of the provision. If modification is not possible, the invalid provision shall be replaced by a valid provision that achieves, to the greatest extent possible, the economic, business, and other purposes of the original provision.
18. Waiver
No failure or delay by Pizzana in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law.
19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or additional terms published by Pizzana on our website, constitute the entire agreement between you and Pizzana concerning your use of our Services and supersede all prior and contemporaneous negotiations, representations, warranties, understandings, and agreements, whether oral or written, between you and Pizzana with respect to the subject matter hereof.
No oral or written representation, statement, or warranty made by any employee or agent of Pizzana that is not contained in these Terms shall be binding upon Pizzana or form part of this Agreement.
20. Electronic Communications
By using our Services, you consent to receiving electronic communications from us, including but not limited to order confirmations, receipts, promotional offers, and notices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
